Dealing With Unlawful Content

I spoke yesterday on an exceptionally challenging panel on Illegal Content and Lawful Access at the 2007 Canadian Telecom Summit.  The panel, which included passionate (and disturbing) presentations on child exploitation and online hate, was bookended by Pam Dinsmore from Rogers (presenting the ISP perspective) and myself.  The slides from my brief presentation are posted below.  The gist is that these issues are complicated and one size does not fit all.  I tried to identify some core principles that cut across all issues that include:

  • where possible offline=online
  • judge made decisions/oversight
  • transparency
  • accountability
  • err on the side of free speech

Admittedly, no real solutions, but a better sense from the panel of how difficult it is to find the right solution.

  1. I\’m not sure what you mean by online=offline

Do you mean that, when ever possible, the same rules (principles, laws, etc) should apply to both online and offline content?
