CRTC Denies Hate Site Request

The CRTC has issued a quick decision on the Warman request to allow Canadian ISPs to block access to two U.S. based hate sites.  The Commission denied the application, basing its decision primarily on the fact that other parties (the carriers, the sites) were not provided with notice and the opportunity to be heard.  I'll be writing on this case in my column next week, but my quick take is that the CRTC is right to ensure that all parties have the opportunity to present their views on the issue and therefore an immediate interim order is impractical.  However, the need for a full consultation does not remove the need to address the issue in a comprehensive fashion.  This case has placed an important issue squarely on the Commission's agenda and important procedural safeguards should not be used an excuse to leave it unresolved.

I fail 100% to see how this is the same.

A website is not subject to the Canadian Broadcasting act, that I know of. Also, CHOI-FM is within Canada and must repect the regulations set forth here. Does the CRTC control the Vermont station I can get in on my radio? Can they control that Vermont station if I object to their words? Will the CRTC set up an FM channel airwave capturing tool at the border so i can't hear it?

Goldberg's nagging and rant doesn't even make scense as he said it.

To have Canadian ISP's start censoring is to give them too much power. They are bad enough as it is.

The whole failing here, in my opinion, is the law-enforcers (police ect) who have failed in their job. Having failed in their job forcing Warman to leave Canada for fear of his and/or his families life is the failing of the justice system either here and/or the States where its comming from.

Do we really need the CRTC to censor? Will a Canada wide ONLY censor do ANYTHING at all? What will it accomplish? It will only bring more attention to the hate site and have all of us censored.

Its law enforcements job to take care of crimes such as this and murder threats. Not the CRTC.

Is Warman any safer at all if a Canadian IP can't read the hate site? please, thats a joke. Of course he isn't. All it will accomplish is us Canadians being censored and millions of others being able to see his address.

Block it.. Censor it... Hide it.. what a joke. It does not stop it or prevent non-Canadian IP's from seeing it.

This whole things stinks and this run-around-the-truth bullpoopoo that Goldberg, Warman et al want hidden from Canadians is just that.

Sounds more to me like a cry to net-censorship here in Canada for HIS own false sence of security (which is no security since it will still BE THERE).

If it was Censored for Canadian IP's only, would he still leave Canada out of fear for his life? He would be crazy not to.

I never complained so much online before.. I'll collect my thoughts and put it to the CRTC, maybe they don't know about relays, anon proxy, SSL/SSH tunnels and portals.. blocking it does nothing... I better let them know we need to block the world from Canada to truely keep people from seeing it. Who's the winner now? sheeez.

See, I'm not saying that Richard Warman's involvement in certain actions should invite violence against his person, but his involvement with and support of violent groups should. Just as the supreme court decision in the zundel case stated that Ernst Zundel can't claim he is against violence and get involved with known violent groups. The same goes for Richard Warman.

Now that the S**t hit the fan, he is crying and trying to urge all of canada to abide by his terms. He wants all of canada to not access a website because he is the target.

Aside from these points. there was never a threat made against Mr. Warman or against the Canadian Jewish population directly. That's a misrepresentation of the facts. Read overthrow88.blogspot.com for the actual quote.

They picketted his street with masked faces and sticks and weapons. the cops acted as a barrier between them and Mr. Fromm’s house. This group of individuals that Richard Warman has given speeches to and financed, were also responsible for the firebombing of another individual’s house, including the posting of instructions to do it.

After the event, this group posted paul fromm’s address online in a “declaration” about their “successful” mission attacking his house.

While they were protesting however, a member of the group was holding up a sign that said, “Thank you Richard Warman for the bus rental” and another with “Die Nazi Scum”

As you can see in the pictures, some of the members are masked in this protest. Good thing the cops outnumbered the protesters threefold.

Now this isn’t the end. Paul Fromm is an individual that Warman is trying to sue, seemingly unsuccessfully, for calling him a censor. Also, Paul Fromm has been doing free legal defense work for individuals that Richard Warman files complaints against. A month before the attack on Paul’s house, Richard Warman was unsuccessful in trying to ban Mr. Fromm from defending people for free. At the Canadian Human Rights Tribunal, the complainant gets a lawyer from the Canadian Human Rights Commission to prosecute the case for him (for free), but the respondents have no right to legal representation, so they have to pay for their own lawyers. Since most people that Richard Warman targets are youth that post messages online, they can’t afford that.

Richard Warman also filed a human rights complaint against someone alleging that he was making racist posts online recently. Before the case even went to court, or was even investigated by the canadian human rights commission, Warman called up the university where this guy worked and told them he was a racist and convinced them to fire him. He has affected other peoples’ lives and threatened their safety as well on many occasions. You live by the sword, you die by the sword.

So it’s okay for RIchard Warman to do this to other individuals and then whine about it when it gets reciprocated. At least it’s a good thing that the CRTC rejected the application.

Ignore what the media hides, but the application was attempting to carry out the action ex parte (with no one being allowed to oppose them). Is this the kind of action defensible? Is this a dictatorship where well-connected civilians should be able to file an-unopposed motions to change laws?

The Ruling Also states that Richard Warman is not a legal applicant because he is not from the ISP community. So all this was an utter failure.

And to make matters much worse, Bernie Farber filed an affidavit that he was a qualified expert in the hate field while leaving out that the last time he tried to testify (in 1999), he was DISQUALIFIED from testifying because he had made comments to the media that indicated that he is dangerously biased would likely say anything to get some people nailed. There is no information to show he has been requalified as an expert witness since then. And the fact that he decided to go in on the ex parte application shows that his heart is not in the right place.

AFTER ALL THIS. GOD FORBID THAT ANYONE POSTS HIS ADDRESS ONLINE OR CALLS FOR A PROTEST ON HIS STREET!

Next time you get this affected by a story, google the names and events of people involved and you might find out more than you read in the daily rags.
