Pirate Bay Demands Retrial Amid Conflict Allegations

A lawyer representing one of the men convicted in the Pirate Bay trial has called for a retrial after reports that the judge was a member of the same copyright protection organizations as several of the main entertainment industry representatives. Judge Norstrom acknowledged to Swedish Radio that he was a member of The Swedish Association for Copyright, as well as a board member of the Swedish Association for the Protection of Industrial Property. He also said he has worked alongside Monica Wadsted -- who represented the American movie industry in the trial -- to solve disputes related to Internet domain names.

The judge who ruled against the Pirate Bay may have had motivations beyond the facts of the case. And so (one of) the Pirate Bay's defense lawyer is asking for a retrial.

I hope they have the same rules and regulations on potential conflicts of interest that we have here. It seems to me if a judge did that here they could easily loose their reputation ...

Something tells me they don't elect their judges in Sweden! (like they do in the States) ... but that is a whole other can of worms ...

They allow the exact same thing on their search engine. Pirates bay isn't hosting anything (unlike google).

Example, you can find all your torrents on google using advanced search (Just like Pirate bay). And unlike Pirate Bay, Google is raking in millions due to this.

Canadian ISOhunt is not different than google. Why are google executives walking free? Why are the industry cartels not asking for jail time for googles executives?

Huge double standard.
Google is making huge profits.

Was Quebec Torrent any different than Google?

Will Quebec shut down Google?

Will the Supreme court single google out?

Will CRIA go After google?

Google has had these torrents and links just like isohunt, QC-torrent and Pirates bay longer than anyone else, and profited off of it longer than anyone else.

This also raises the issue of those UK providers blocking Pirates Bay.

Why are they not blocking Google as well?

VERY huge double standard here while google executives walk free all the way to the bank.

I hope the EU see's this for what it is.

Andy...of course not everyone thinks it's OK to pirate movies, only if they really wanted to, or could not afford the real thing yet or simply trying out a movie or two just to see if they really like it then they could afford it eventually. Think outside of the "box" next time.

Let's face it, Google is a harder target to hit, for a couple of reasons. First of all, they are a general search engine, not just a Torrent search. Secondly, they have sufficient cash to do a good job of defending themselves.

Now, did the judge screw up? Arguably yes. The thing about conflict of interest with people with this kind of power is that it isn't just about actually being fair or making a judgement based on the facts, it is about perception. In this case, the perception is that he may have had another agenda.
