    The Leaked ACTA Document

    As the ACTA story begins to capture mainstream media attention (front page of the Ottawa Citizen, coverage from the Washington Post, NZ Herald, the Atlantic, Wired), the press release from the now-concluded Seoul talks should be released shortly [update: release out, exactly as predicted].  If the past releases are any indication, it will thank the Korean government and blandly describe the talks on Internet and criminal provisions.  More informative is the actual document that served as the basis for my postings earlier this week.  It is embedded below (direct PDF download).

    So they can simply make everyone an 'unauthorized person', unable legally to view the actual text of the enacted law.

    Which actually happened when someone outside the U.S. found an exploit and slapped the DMCA on it, making it illegal for anyone in the U.S. to read it.

    okay, so the ottawa citizen article said that it only requires a minister's signature to pass ACTA into law. does Parliament not have to ratify it? i understand that under a majority government it would be a technicality, unless more backbenchers than i would expect stood on principle to vote it down, but we currently have a minority parliament and i could see the bloc and ndp standing against it, at least.

    further, how on earth would the signing of the treaty usher the criminal provisions into law? or even the civil provisions? suits and criminal cases all have to be pursued under an act of parliament... you can't exactly charge someone under the anti-counterfeiting trade agreement, after all. it seems to me that after signing ACTA the government would then have to amend the copyright act, which would require three readings as well as a committee process with massive consultations as the opposition takes full advantage to rally to them the vote of everyone who's ever downloaded music, which is pretty much every single person under 40. so we wouldn't see acta provisions in place in canada until 2011, probably, assuming a 2010 treaty signing. or am i off about this?

    The U.S. District Court decision referred to in the Slashdot article was later reversed on appeal. Veeck v. Southern Building Code Congress International, Inc., 293 F.3d 791 (5th Cir. 2004 en banc), http://cases.justia.com/us-cou...1/521953/, cert. den., 123 S.Ct. 2636, 156 L.Ed.2d 674.

    The Supreme Court has never ruled directly on that issue. But there is a very large body of case law in the U.S. holding that copying of law is not subject to copyright infringement claims.

    I think it is wise for all of us (all arround the world) to contact both the political parties in your country and your ISP to not only get to know what their perspective on this is, but maybe even to take a stand against this.

    We should also spread this information. Speak about it with your friends and collegea's. If it is not an issue for them then make it one.
