The European Commission has launched a public consultation on the state of Canadian economic rules ahead of the negotiations on a Canada – EU free trade agreement (hat tip – Jamie Love). The consultation includes a full chapter on intellectual property including questions on satisfaction with Canadian IP law, whether there is effective enforcement, and which area Europeans would like addressed in a trade agreement. While Geographical Indications was thought to be the primary European issue, the IFPI obviously has other ideas.

Because I think we actually have broken through to our leaders who are drawing up something that would possibly be against the IPFI’s position in this debate and something that will be supported by Canadian Industry all around.
This is a test to the Harper Government to see where their loyalties lie prior to the introduction to this bill. Also if the EU were to hold a public consultation, I think they would find that their own people have issues with their copyright laws, and becoming more restrictive.
The EU may swing either way. They could tell the world to back off of Canada with our copyright laws (and may call into question our position on and the validity of 201 report), or they could start peeing on us.
Either way the mood of the EU Members of the Public is well known on how they treat and want their media, and currently seems to have the backing of several individuals who are not afraid to tell Industry when to back off. If they do up a valid public consultation, I think they’ll find the majority the public in their domain has the same attitude if now more so.
Interesting times.
