Congratulations to Ontario Privacy Commissioner Ann Cavoukian for being the first Canadian privacy commissioner to speak out for what should be self-evident: Canada needs a law that requires organizations to report privacy or security breaches to their customers.

My regular Law Bytes column (non-reg. hyperlinked version or Toronto Star version, homepage version) examines the development of Canadian privacy law, arguing that it is unfolding in three stages. The first stage focused on self-regulatory initiatives such as the CSA Model Code. Revise Privacy Law To Protect Public, Not Offenders
In the coming months, Industry Minister David Emerson will lead the federal government on a review of Canada's national privacy law, the Personal Information Protection and Electronic Documents Act (PIPEDA). Critics are likely to call for tougher enforcement measures, better reporting of decisions, and an end to the Federal Privacy Commissioner's policy that shields organizations that are the target of successful complaints.
