The Conservative party holds a policy convention next week and documents posted by National Newswatch reveals that there are a several minor proposed changes to the party's position on copyright. First, there is a proposal to extend support for private copying of sound recordings to video as well. The new provision would read that "the Conservative Party believes that the objectives of copyright legislation should be (i)(d) to continue to allow an individual to make copies of recordings of musical works and video for that person’s personal and individual use." Second, another reform reaffirms support for the elimination of the private copying levy with "the Conservative Party supports the elimination of the levy on blank recording materials." Third, "the Conservative Party believes that government should give consideration to educational public policy goals within the copyright framework and work with industry to increase awareness and develop a public education campaign to better inform users and creators on the copyright laws in Canada." The key changes would be the two private copying proposals since together they foreshadow a policy position that broadens fair dealing for private copying of audio and video (ie. time shifting and format shifting) without further compensation through a private copying levy.

a) to create opportunities for Canadian creators to enjoy the fruits of their labour to the greatest possible extent;
b) to ensure that the rights of Canadian creators are adequately protected by law;
c) that these rights are balanced with the opportunity for the public to use copyrighted works for teaching, researching
and lifelong learning;
d) to continue to allow an individual to make copies of sound recordings of musical works for that person’s personal
and individual use; and
e) that enforcement is applied fairly and in accordance with international standards.
ii) The Conservative Party believes that reasonable access to copyright works is a critical necessity for learning and
teaching for Canadian students and teachers, and that access to copyrighted materials enriches life long learning

v) require applicants for parole to demonstrate to the National Parole Board that they have been rehabilitated.

Fascinating. Nothing at all about encouraging the creation of works. Nothing about users who aren’t using works for “teaching, researching and lifelong learning”. No recognition of the conflict between copyright and tangible property rights. And of course nothing about problems such as orphan works.
Overall, a very dated policy (except for the parts that Prof Geist points out). And of course scrapping the levy was part of their policy before, it just somehow got forgotten when it came time to draft the actual bill, so we still live in a country where blank DVDs are cheaper than blank CDs.
If we see any criminalization of the consumer as we did in C-61 (which I’m to beleive that a lot of the Canadian Media industry is against and didn’t like with C-61), those who are creating works better be prepaired for some extremely rough times a head. Best not to piss off your income base, when that income base already has a confidence problem and are buying less. Not a good economic approach, nor policy. Industry needs to be forced to adapt, not consumers.

This is just a gargantuan flaw of logic. The entertainment cartels are attacking unsanctioned uploaders, or distributors. The private copying levy taxes downloaders and basically the general public at large who copy cartel-content or not.
The design of the private copying levy is to grant Unenforcible private copying “rights” to the public for a tax collected on sales of blank media and devices.

The hilarious thing is we already have private copying rights, but people like you would have the cartels charge us for it.
The lawsuits are for unsanctioned uploaders, uploaders who distribute cartel-content without the cartel-approved sticker.
The private copying levy is another layer of the Collection Scam. It’s scamming you on rights you already have; and it’s scamming you again and again multiple times, such as stealing from you every time you make a personal copy/backup of legally obtained music onto a new blank media or device. For example, you buy a music CD and make 2 backups, one for car and one for home, while the original is safely stored unused; you shouldn’t have to pay this scam twice and every time you want to make a personal copy of your music.
Nevertheless, you shouldn’t have to pay some (con) “artists” for the privilege of storing data onto blank media and devices, or storing your own music creations. My favourite musicians do not belong in these (con) “artist” groups, so I shouldn’t have to pay these (con) “artists” at the expense of my favourite artists who won’t see a penny from the taxing levy.
In the end, all of the uploaders are getting sued, all who just want to make a copy of their data get scammed, and everybody else gets all rightous on the downloaders without realizing they (even politicians) are also downloaders.

What is “personal and individual use?”
I just received an email from my cellphone company in which I was informed that a ringtone constitutes a “public performance” and hence they can only allow DRM’d music purchased from a “legitimate” source, such as their store, to be used on my phone. This is ridiculous. If that is a public performance, then so is playing music in my car with the window rolled down. Perhaps the question of whether a ringtone is a personal and individual use is worth clarifying when the copyright law is reviewed.
